Kausik (Rejected) CRM (M) 2807 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Manikchak Police Station Case No. 579 of 2025 dated 01.08.2025 under Section 65(1) of the BNS, 2023 and Section 4 of the POCSO Act. And In the matter of : Subarna Mondal @ Subarno Mandal ……Petitioner. Mr. Md. Anwar Hossain Mr. Benajir Hasna ….for the Petitioner. Mr. Gouranga Kr. Das Mrs. Shalini Bairagi …for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 10 months. Charge sheet has already been submitted. Learned advocate submits that there was a relationship between the petitioner and the minor victim. Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the statement of the victim under section 183 of the BNSS. I have taken into account the materials appearing in the case diary as well as the stage of the case. At this stage, I am not inclined to release the petitioner on bail as the evidence of the victim has not been completed. 2 Petitioner would renew his prayer for bail after the evidence of the victim is over. Learned Trial Court is directed to take steps so that at the earliest, within a period of 3 months from the date of consideration of charges, the evidence of the victim is recorded. With the aforesaid observations CRM (M) 2807 of 2025 is dismissed at this stage. Report and Memo of Evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
