Learned advocate appearing for the petitioners submits that the alleged recovery in the present case is 12 kgs. of ganja and the petitioners are in custody for almost three months. Charge- sheet has been submitted before the jurisdictional court.
Learned advocate appearing for the State opposes the prayer for bail.
I find that the seizure in the case is of intermediate quantity and as the charge-sheet has been submitted, petitioners have made out the case for bail, as such, their prayer for bail is allowed. The petitioner no.1, namely, Rubel Deb and the petitioner No.2, namely, Srabon Nama @ S. shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be
2 local to the satisfaction of the learned Judge, Special Court, under NDPS Act, Nadia, Krishnanagar. If on bail, the petitioners shall be physically present on each and every date before the learned trial court and the petitioners being the residents of Tripura will not leave the jurisdiction of the learned trial court without prior permission of the learned special court.
Thus, CRM(NDPS) 1423 of 2026 is allowed.
