Mr. Shataroop Purkayastha. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 9 months. Charge- sheet has been submitted but till date charges have not been framed. Prosecution has relied upon 16 witnesses in order to prove its case and there is no possibility of the trial being concluding in near future, as such the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail. Having regard to the quantum of seizure in the present case, I am not inclined to release the petitioner on bail as rigors of Section 37 of the NDPS Act is attracted. As such, the prayer for bail of the petitioner is rejected at this stage. The petitioner will renew his prayer for bail after the independent seizure list witnesses are 2 over. To that effect, it is directed that at the earliest charges be framed and within three months from the date of framing of charge, the evidence of the independent seizure list witnesses be completed. Accordingly, CRM(NDPS)1427 of 2026 is dismissed at this stage. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
