::1:: (117-A) IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-26872-2026 (O & M) Date of Decision: 08.07.2026 Jaswinder Kaur ... Petitioner Versus State of Punjab ...Respondent CORAM: HON'BLE MR. JUSTICE JASJIT SINGH BEDI Present: Mr. Sangram Singh Sekhon, Advocate with Ms. Kimreet Kaur Khurana, Advocate for the petitioner. Mr. Athar Ahmed, DAG, Punjab. **** JASJIT SINGH BEDI, J. The prayer in the present petition under Section 483 BNSS is for the grant of regular bail in case bearing FIR No.0025 dated 09.03.2026 under Sections 109, 61(2) and 48 of BNS (corresponding Sections 307 and 120-B IPC) and Section 25 and 27 of the Arms Act, 1959 registered at Police Station City Banga, District SBS Nagar. 2. The learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. In fact, the petitioner who happens to be the mother of Jaspreet Singh @ Kannu @ Jaskaranpreet Singh is not in touch with her son for the last many years and there is no question of any amount being received by the petitioner at the instance of her son to be extorted from the complainant. As the petitioner is in custody since 12.03.2026 but none of the 12 prosecution witnesses has been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, the petitioner is entitled to the concession of bail. VISHAL SETHI 2026.07.09 17:10 I attest to the accuracy and integrity of this document ::2:: 4. The learned counsel for the State, on the other hand, while referring to the reply dated 07.07.2026, which is taken on record, contends that grave allegations have been levelled against the petitioner inasmuch as her son made a telephonic call to the complainant to extort Rs. 50 lacs, half of which was to be paid to the petitioner. The nature of the allegations do not entitle the petitioner to the concession of bail. He, however, concedes that the petitioner is in custody since 12.03.2026 but none of the 12 prosecution witnesses has been examined so far. 5. I have heard the learned counsel for the parties. 6. The veracity of the prosecution case against the petitioner shall be adjudicated upon during the course of the Trial. Admittedly, the petitioner is in custody since 12.03.2026 but none of the 12 prosecution witnesses has been examined so far. Therefore, the Trial in the present case is not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioner is not required. 6. Thus without commenting on the merits of the case, the present petition is allowed and the petitioner-Jaswinder Kaur is ordered to be released on bail subject to her furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 7. The petition stands disposed of.
