THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI WRIT PETITION NO: 14848 OF 2026 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the high handed, illegal acts, deeds things of the respondent No.5 trying to evict me without completion of the tenure period vide letter No. Nill/2023, dated 12.07.2023 as illegal, arbitrary, violation of the rights guaranteed by the constitution of India and violative of Andhra Pradesh charitable and Hindu Religious Institution and Endowments Act, 1987 and other consequential reliefs and to pass…”

As per the letter of lease impugned in this writ petition vide Nil/2023, dated 13.07.2023, the lease of public auction was held on 12.07.2023 for a period of three years whereby the petitioner stood as successful bidder and lease was granted in his favour. However, the respondent authorities have issued public auction notice dated 10.05.2026 calling for tenders for the subject land in Sy.No.67/1 to an extent of Ac.4.32 cents. 3.
The submission of the learned counsel for the petitioner is that his lease for the period three years will come to an end by 12.07.2026 however the respondent authorities without waiting for the expiry of the lease period have issued public auction notice and also issued notice under Section 83(2) of Act 30 of 1987 treating the petitioner as an encroacher which is contrary to the very lease granted in his favour. 4. On instructions of the District Endowments Officer, Bapatla, dated 27.05.2026, the learned Assistant Government Pleader for Endowments submitted that as per Rule 7 (b) of Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Lease of Agricultural

Lands Rules, 2003 (in short „the Rules, 2003‟), the executive authority shall conduct tender-cum-public auction compulsorily three months before expiry of existing lease period, the executive authority shall also issue a public notice of ten days to that effect, duly mentioning the upset price fixed basing on prevailing rents in the vicinity. He further submitted that till expiry of lease period of the petitioner i.e., 12.07.2026 he will not be evicted and that the respondents will follow Rule 7 of the Rules,
2003. 5. Recording the above submissions, the writ petition is disposed of directing the respondents not to evict the petitioner till 12.07.2026 on which day the lease of the petitioner would expire. It is agreed by the petitioner that he will hand over the leased property after expiry of the lease period.
