Learned advocate for the petitioner submits petitioner is in custody for more than 3 years and 9 months and till date the evidence of the prosecution witnesses have not been completed. Learned advocate for the State has submitted a report of the Officer of the AHTU, CID, West Bengal which reflects that the evidence of PW 7 is in progress and one more witness is proposed to be examined. Having considered the period of detention of the present petitioner and the fact that the next date is fixed on 17th July, 2026, I direct the learned Trial Court to fix regular dates from 17.07.2026, so that the evidence of the witnesses are 2 completed at the earliest and by 10th October, 2026 the examination of the accused persons under Section 313 of the Cr.P.c. is concluded. If, for reasons otherwise, the learned Trial Court is unable to complete the evidence, in that case, if a bail application is taken out by the accused, the same be considered leniently by the learned Trial Court. With the aforesaid observations, at this stage, CRM (M) 2739 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
