Chauhan … for the Petitioner(s) Mr. Shataroop Purkayastha … for the State-respondent(s) Learned advocate for the petitioners submits that the petitioners are in custody for one year one month and till date only eight witnesses have been examined out of the cited 12 witnesses. Learned advocate for the State opposes the prayer for bail. I have considered the chemical examiner’s report which reflects the presence of Diacetylmorphine (heroin), 6- Monoacetylmorphine, Codeine, Acetylcodeine. Having regard to the fact that the same have not been quantified, the petitioners are covered by the proposition as laid down in [Sentu Seikh v. State of West 2 Bengal [SLP (Crl.) No. 13987 of 2025], as such, I am inclined to enlarge the petitioners on bail. Hence, the prayer for bail of the petitioners is Allowed. Accordingly, the petitioners viz, Diwakar Mandal @ Dibakar Mandal and Rajesh Mandal shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act, 4th Court, Malda. If on bail, the petitioner shall also make themselves physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Malda without prior permission of the learned Special court/trial court.
