This application under Article 227 of the Constitution of India is at the instance of the husband and is directed against an order dated 12th August, 2025 passed by the learned Additional District Judge, Paschim Medinipur in Matrimonial Suit No. 650 of 2021. By the order impugned the application under Section 36 of the Special Marriage Act which was registered as J. Misc. Case No. 05 of 2021 was disposed of thereby directing the petitioner/husband to pay a sum of Rs. 3,000/- per month for the wife and Rs. 4,000/- per month for the minor child with effect from the date of filing of the application. The learned advocate appearing for the petitioner submits that the father of the petitioner is dependent upon him and the petitioner is not in a position to pay the amount as directed by the learned trial judge. The learned trial judge has recorded a factual finding that the wife/opposite party does not have any independent income. The learned trial judge after considering the nature of employment of the husband has directed the opposite
2 party to pay Rs. 3,000/- per month for the wife and Rs. 4,000/- for the minor child. Considering the present price index this Court is of the considered view that the amount of alimony pendente lite directed to be paid by the petitioner to the opposite party cannot be said to be excessive. Without the aforesaid amount it will be very difficult for the wife and the minor child to sustain. For such reason, this Court is not inclined to interfere with the order impugned. C.O. 2115 of 2026 stands disposed of with the above observations. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
