This application under Article 227 of the Constitution of India is at the instance of the father praying for a direction upon the learned Additional District Judge, Fast Track 2nd Court at Howrah to dispose of the Misc. Case No. 168 of 2023 expeditiously. Mr. Bhattacharyya learned advocate appearing for the petitioner submits that the misc. case is pending from the year 2023 and a direction be passed upon the learned trial judge to dispose of the same as expeditiously as possible. Record reveals that the mother/opposite-party herein filed an application challenging the maintainability of the misc. case on June 6, 2026. The petitioner was directed to file written objection and July 4, 2026 was fixed for hearing of such application.
2 Mr. Bhattacharyya submits that the written objection to the application filed on June 6, 2026, has already been filed by the petitioner and the next date for hearing of such application has been fixed on July 31, 2026. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge. In the light of the submission made by the learned advocate appearing for the petitioner, CO 2052 of 2026 stands disposed of by requesting the learned Additional District Judge, Fast Track 2nd Court at Howrah to take up the hearing of the petition dated June 6, 2026 on the next date fixed, i.e., on July 31, 2026, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. If the said application is decided in favour of the petitioner herein, the learned Additional District Judge, Fast Track 2nd Court at Howrah shall make an
3 endeavour to dispose of the misc. case as expeditiously as possible.
