Mr. Rajendra Banerjee, learned Additional Public Prosecutor along with Mr. Ramashis Mukherjee, learned advocate, appears on behalf of the State. Their appointment may be regularized by the concerned authorities.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 3 years 7 months and only 2 witnesses have been examined out of the cited 23 witnesses.
Learned Additional Public Prosecutor appearing for the State has referred to the case diary and submitted that the offence is a heinous offence. To that effect, statement of the witnesses has been brought to the notice of this Court.
Having considered the gravity of the offence, I am not inclined to release the petitioner on bail. However, prosecution
2 would complete all the vulnerable witnesses within a period of six months from the date of communication of this order.
The Superintendent of Police, Birbhum is directed to appoint a nodal officer to ensure that on the schedule fixed by the learned trial court, witnesses are positively present.
Learned trial court is directed not to adjourn the case if a witness is present until and unless circumstances are beyond the control of the learned trial court.
At this stage, the prayer for bail of the petitioner is rejected. Petitioner will renew his prayer for bail after the aforesaid period is over.
Accordingly, CRM(M)2820 of 2025 is dismissed.
Report submitted by the State be kept with the record.
