GP FOR REGISTRATION AND STAMPS The Court made the following: 3 ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd respondent in orally refusing to receive and register the sale deed presented by the Petitioner in respect of the schedule property situated at Guntur Municipal Corporation, Kondepadu Village, Survey No.160/161 admeasuring 300 square yards, as illegal, arbitrary, unconstitutional, and violative of Articles 14 and 300-A of the Constitution of India, and consequently direct the 3rd Respondent to receive, process, and register the said document if it is otherwise in order….” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 3. The learned counsel for the petitioner submits that the petitioner, being the sole legal heir, is the absolute owner of the schedule property and intended to sell the same for her medical and financial needs, but when the sale deed was presented before the 3rd respondent, the 3rd respondent refused to receive and register the document without assigning reasons or passing a written order. Aggrieved by the said impugned action, the present writ petition is filed seeking a direction to register the document in accordance with law. 4. The learned Assistant Government Pleader for the respondents submits that the 3rd respondent will follow the due process of law. 5. Having regard to the facts and circumstances of the case, the 3rd respondent is directed to receive and register the sale deed presented by the petitioner in respect of the schedule property situated in Sy.No.160/161 4 admeasuring 300 square yards, Kondepadu Village at Guntur Municipal Corporation, by following the due process of law. 6. In the result, the Writ Petition is disposed of. No order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
