Learned counsel appearing on behalf of the petitioner submits as follows. There was a relationship between the two consenting adults. After the relationship turned sour, the present FIR was lodged to falsely implicate the present petitioner.
Learned counsel appearing on behalf of the de facto complainant opposes the prayer for anticipatory bail. She submits that the relationship between the two was entered into on a specific promise of marriage given by the present petitioner. The petitioner was responsible for the two earlier abortions. In the case of the 3rd pregnancy, the petitioner assaulted her severely leading to injury.
Learned counsel appearing on behalf of the State relies on the case diary including the medical report of the victim showing the date of discharge as 08.02.2026. The diagnosis was recorded as physical assault during pregnancy. He also relies on the statements of local
2 witnesses including the landlord of the premises where the two used to stay.
Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail is rejected.
