2 Dr. YLR,J CrI..P No. 12950 of 2025 Dated 06.01.2026 ^ The Court made the following: ORDER: The Criminal Petition has beeh filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.352 of 2025 of Kancharapalem Police Station, Visakhapatnam City, registered against the Petitioner/Accused No.1 herein for the offences punishable under Sections 109 (1) and 118(1) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Heard the learned counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, this is the second bail application. This Court vide order dated 03.12.2025 in CrI.P.No.11658 of 2025 dismissed the first bail application.
The second bail application was filed on
10.12.2025. In the interregnum period, on 05.12.2025, after thorough investigation, the charge sheet was filed. The petitioner was arrested on 30.09.2025. He has been in judicial custody for the past 98 days. There is a change of circumstance. 4. The petitioner is a permanent resident of Kapparada, Kancharapalem Visakhapatnam. He has a fixed abode. If he is enlarged on bail with some stringent conditions, he may not evade the process of law. It takes a considerable length of time for the learned Trial Court to take up the matter for trial. Keeping the petitioner in judicial custody for such an indefinite period
w 3 Dr.YLR.J Cri.P No. 12950 of 2025 Dated 06.01.2026 would not serve any purpose. No petition seeking custodial interrogation of the petitioner has been filed, and the period within which an application could be filed for custodial interrogation is also completed. The nature of the injuries suffered by the victims is simple in nature. 5. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioner/Accused No.1, this Court is inclined to enlarge the Petitioner/Accused No.1 on bail with some stringent conditions. 6. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioner/Accused No.1 shall be enlarged on bail - subject to his executing bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the like sum each to the satisfaction of the learned VII Additional Judicial Magistrate of First Class, Visakhapatnam. ii. The Petitioner/Accused No.1 shall appear before the learned Trial Court on each and every adjournment without fail. iii. The Petitioner/Accused No.1 shall not leave the limits of the State of Andhra Pradesh without prior permission from the learned f-' lurt concerned. 4 Dr. YLR,J Cri.P No. 12950 of 2025 Dated 06.01.2026 iv. The Petitioner/Accused No.1 shall not commit or indulge in commission of any offence in future.
V.
