Following reliefs have been prayed in this petition:- 3 “10.1 That, this Hon'ble Court may kindly be pleased to call the records pertaining to the case from the respondent authorities. 10.2 That, this Hon'ble Court may kindly be pleased to quash the impugned orders dated 06.01.2022 & 07.02.2022 (Annexure P/1) and further be pleased to direct the respondent authorities to forthwith release the bank account of petitioner bearing account no. 606026022280 from hold. 10.3 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to release the whole bonus amount on account of sale of paddy in favour of petitioner, in accordance with law. 10.4 To kindly grant any other relief which may be deem fit in the given facts and circumstances of the instant case.” 2. Learned counsel appearing for the petitioner submits that the paddy of the petitioner has already been purchased by the authorities and accordingly the petitioner has been paid the sale amount of the paddy. However, it is submitted that the bonus amount payable in respect of the said paddy has not been released till date, due to which the petitioner is facing hardship. Learned counsel, therefore, prays for a direction to the respondents to release the outstanding bonus amount payable to the petitioner. 3. Learned State counsel does not dispute the fact that the paddy produced by the petitioner has already been purchased by the 4 authorities. However, submits that appropriate action with regard to payment of the bonus amount shall be taken in accordance with law. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Having considered the submissions made by learned counsel for the parties and upon perusal of the material available on record, it is evident that the paddy produced by the petitioner has already been purchased by the authorities and the sale amount thereof has also been paid to the petitioner. Therefore, so far as the payment of bonus amount is concerned, the concerned authorities are required to examine the claim of the petitioner and ascertain as to why the same has not been released till date, if the petitioner is otherwise entitled for such payment. 6. In view of the aforesaid, the present writ petition is disposed of with a direction to the petitioner to submit an appropriate representation/application before the concerned authority raising his grievance with regard to non-payment of bonus amount. Upon receipt of such representation, the concerned authority shall consider and decide the same in accordance with law by passing a reasoned and speaking order within a period of 45 days from the date of receipt of such representation. 5 7. It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner, and the concerned authority shall take an independent decision in accordance with law. 8. Since the other grievance raised by the petitioner has already been resolved, no further adjudication is required in that regard. 9. With the aforesaid observation and direction, the writ petition stands disposed of. 10.No order as to costs. sd/- (Amitendra Kishore Prasad) Judge Vishakha
