GP FOR SERVICES I 2 The Court made the following ORDER: The present writ petition is filed questioning the action of the respondents in not considering the petitioner’s case for promotion to the post of Tahsildar as arbitrary and illegal. 2. The facts leading to the filing of the writ petition are as follows: a. The petitioner was appointed as Deputy Tahsildar pursuant to APPSC Notification No.18/2016 dated 08.11.2016 under B.C-D category. Thereafter, the petitioner was appointed as Additional Private Secretary to the then Minister for Agriculture, vide G.O.Rt.No. 864 dated 19.06.2023. Subsequently, the petitioner was again placed against the post of Tahsildar on temporary basis and has been continuously discharging such duties. In the provisional integrated seniority list issued on 21.05.2026, the petitioner’s name was included at Sl. No. 225 in Zone-III under the panel year 2017-2018, making the petitioner fully eligible for regular promotion to the post of Tahsildar. b. The respondent No.2 for conducting DPC issued a memo dated 18.05.2026 to all the District Collector calling for pending disciplinary / vigilance cases and further details regarding Deputy Tahsildars for their promotion to the post of Tahsildars. The respondent No.2 further enclosed list of employees list to the memo. c. The petitioner contends that due to political vengeance, the petitioner disciplinary proceedings are going to be initiated against him. Since no charge memo or charge sheet was framed against the petitioner, the petitioner is eligible for the promotion, hence this writ petition is filed. 3. Learned counsel for the Petitioner while relying on G.O.Ms.No.66 GENERAL ADMINISTATION (SERVICES-C) DEPARTMENT dated 30.01.1991 submitted that the promotion can be deferred only when 3 charges of misconduct are framed by the competent authority and served on the concerned delinquent officer. Learned counsel also relied on G.O.Ms.No.257 GENERAL ADMINISTATION (SER-C) DEPARTMENT 10.06.1999, which provide for Promotion on adhoc basis, provided the charge is not of a serious nature. The further contention is that this Court in similar circumstances in W.P.No.14410 of 2025 directed the Respondents to consider the case of the petitioners therein for promotion to the post of Assistant Director/Assistant City Planner in terms of G.O.Ms.No.257 dated 10.06.1999, if the Petitioner is in the zone of consideration. 4. Learned Assistant Government Pleader would submit that as on date no disciplinary proceedings have been initiated against the Petitioner, the Petitioner's case could be considered for promotion in the event no charge memorandum is issued as on the date of promotion in terms of G.O.Ms.No.66 dated 30.01.1991. 5. Considering the submissions made, the writ petition is disposed of directing the Respondents to consider the case of the Petitioner for promotion to the post of Tahsildar in terms of G.O.Ms.No.66 dated 30.01.1991. No order as to costs.
