THE PRINCIPAL ASHWINI AYURVEDIC MEDICAL COLLEGE &AMP AND PG CENTRE HOSPITAL NO.405/1, OPP: BATHI LAKE ASHWINI NAGAR P.B.ROAD DAVANAGERE-577 566 …RESPONDENTS (BY SRI JAGADEESHGOUD PATIL, ADVOCATE FOR R-1; SRI MALLIKARJUN G. CONTRACTOR, ADVOCATE FOR R-2) THIS WRIT PETITION IS FILED UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA, SEEKING CERTAIN RELIEFS. THIS WRIT PETITION IS LISTED FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, AN ORDER IS MADE AS UNDER: ORAL ORDER Sri.Gopalakrishnamurthy C., counsel for the petitioners, Sri.Jagadeeshgoud Patil, counsel for respondent No.1 and Sri. Mallikarjun G. Contractor, counsel for respondent No.2, appeared in person. 2. This petition is filed seeking the following reliefs: (a) Issue a writ of mandamus or any other appropriate writ, order or direction directing the respondents to pay minimum wages, including arrears / back - 5 - HC-KAR NC: 2026:KHC:34610 WP No. 16079 of 2025 wages, in pursuance to the notification No.KAE 125 LWA 2015 dated 06.01.2017 as Annexure-C. (b) Issue writ of certiorari by quashing the impugned endorsement passed/issued by respondents in endorsement Ref.No.AMC/792/24-25 dated 27.01.2025 as per vide Annexure-F. (c) To pass such other orders as this Hon'ble Court deems fit by this Hon'ble Court as per the facts and circumstances of the case to meet the ends of justice and equity. 3. Counsel for the respective parties advanced their submissions. Counsel for the respondents submitted that a memo has been filed, stating that the petitioners have already approached the Labor Commissioner seeking minimum wages, and that the matter is pending consideration. Counsel, therefore, urged that the memo be placed on record and the writ petition may be dismissed. 4. I have heard the arguments and carefully perused the papers. - 6 - HC-KAR NC: 2026:KHC:34610 WP No. 16079 of 2025 5. The grievance of the petitioners arises from the endorsement issued by the college, wherein they were informed that they are not entitled to minimum wages. It is sufficient to observe that any person seeking minimum wages must file a claim petition before the Labor Commissioner. In the present case, as the petitioners have already approached the Labor Commissioner, they may pursue their grievance regarding minimum wages in the pending proceedings before that authority. Accordingly, I find no ground to quash the endorsement, since the petitioners have already invoked the jurisdiction of the Labor Commissioner. 6. With the above observation, the petition is disposed of. Because of disposal of the Writ Petition, interim order granted if any stands discharged and pending interlocutory applications if any are disposed of. Sd/- (JYOTI M) JUDGE SS/List No.: 1 Sl No.: 13
