Heard the learned counsels appearing for the parties. 4. Learned counsel for the petitioner submits that the petitioner is in custody since 09.05.2026 in connection with Jirwabari P.S. Case No. 76 of 2026 corresponding to G.R. Case No. 431 of 2026, registered under Section 115(2), 304(2), 308(2), 77, 78, 351(2), 64(1) of B.N.S. and cognizance taken for the offence under Sections 115(2), 308(2), 77, 78/351(2)/64(1) of the B.N.S., now pending in the court of learned C.J.M., Sahibganj. 5. The learned counsel for the petitioner submits that the allegation against the petitioner is that on the pretext of love relationship, the petitioner established physical relationship with the victim and also extorted certain money on the pretext of making certain photograph/video viral. He submits that charge-sheet has already been submitted and the matter is fixed for framing of charge before the learned Court on 14.10.2026. Learned counsel for the petitioner also submits that the petitioner has no criminal antecedent. 6. The learned counsel for the informant submits that he has no objection if the petitioner is enlarged on bail. 7. Learned counsel for the opposite party- State has submitted that if the informant has no objection, who also happens to be the victim, the State has nothing to say. ( 2026:JHHC:28795 ) 2 8. After hearing the learned counsels for the parties and considering the fact that charge-sheet has already been submitted and the petitioner has no criminal antecedent, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sahibganj in connection with Jirwabari P.S. Case No. 76 of 2026 corresponding to G.R. Case No. 431 of 2026, on the following conditions: (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative. (iii) The petitioner will attend the court on each and every date and on account of even single default, the learned court shall cancel the bail bond furnished by the petitioner. (iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court. (v) The petitioner shall fully co-operate with the proceedings before the learned trial court. 9. The instant application is allowed with the aforesaid conditions. 10. Let this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through FAX/e- mail. (Anubha Rawat Choudhary, J.)
