ORAL ORDER
The petitioner is before this Court seeking the following prayers:
"a) Quash the FIR in Crime No. 0071/2025 (ANNEXURE - A) registered by the 1st Respondent (K.G.F. CEN Crime Police Station) against the Petitioner herein for the offences punishable under Section 66(c), 66(d) of the Information Technology Act, 2000 and Sections 318(4), 319(2), 308(2) of the Bharatiya Nyaya Sanhita, 2023, pending before the in the Hon'ble Principal Civil Judge (Jr. Dn) & JMFC at Kolar. b) Quash the complaint dated 18.12.2025 (ANNEXURE - B) filed by the 2nd Respondent before the 1st Respondent (K.G.F. CEN Crime Police Station) for the offence punishable under Section 66(c), 66(d) of the Information Technology Act, 2000 and Sections 318(4), 319(2), 308(2) of the Bharatiya Nyaya Sanhita, 2023. c) Grant such other relief as this Hon'ble Court deems fit in the facts and circumstances of this case, in the interest of justice."

for respondent No.1, Smt.Bhavana N. Patil, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the affidavits. 4. The affidavit of the petitioner reads as follows:
“I, AMIT SAKHUJA, S/o Vinod Kumar Sakhuja, aged about 52 years, residing at No. F-32, 1st floor, Rajouri Garden, Tagore Garden, Delhi - 110 027, the Petitioner herein do herby state on oath as follows:
1. The Petitioner being aggrieved by the filing of Complaint dated 18.12.2025 by the 2nd Respondent before the 1st Respondent Police, based on which the 1st Respondent Police has registered an FIR in Crime No. 0071/2025 for the offences punishable under Section 66(c), 66(d) of the Information Technology Act, 2000 and Sections 318(4), 319(2) of the Bharatiya Nyaya Sanhita, 2023, pending before the in the Hon'ble Principal Civil Judge (Jr. Dn) & JMFC at Kolar, has preferred this instant petition seeking to quash the entire proceeding initiated against him. 2. During the pendency of the present proceedings, the parties have held discussions with a view to bringing quietus to the disputes between them and agreed to settle the dispute between them. 3.
The 2nd Respondent submits that the allegations made in the complaint primarily arose on account of the loss suffered by her in the course of the cyber fraud complained of by her. During the course of proceedings, 2nd Respondent has understood the circumstances placed on

record by the Petitioner and the stand taken by him that he was not one of the persons who contacted, threatened, induced or impersonated any authority before the 2nd Respondent. 4. The Petitioner, without admitting any liability, wrongdoing or involvement in the alleged offences, and solely with a view to avoid prolonged litigation and to bring an end of the dispute, has agreed to pay a sum of Rs.6,00,000/- (Rupees Six Lakhs Only) to 2nd Respondent, this being the total amount of money being directly credited to his bank account bearing No.45910550015 with ICICI Bank. 5. The 2nd Respondent acknowledges that she has agreed to receive the aforesaid amount of Rs.6,00,000/- from the Petitioner in full and final settlement of all claims and grievances that she may have against the Petitioner arising out of or connected with the complaint dated 18.12.2025 and FIR in Crime No.0071/2025. 6. The 2nd Respondent further states that upon receipt of the aforesaid amount, she shall have no surviving claim, grievance, demand or objection against the Petitioner in relation to the subject matter of the complaint and the FIR insofar as the Petitioner is concerned. 7. The 2nd Respondent submits that she has entered into the settlement voluntarily, out of her own free will, without any force, coercion, undue influence, pressure or inducement from any quarter whatsoever. 8. The Petitioner submits that the settlement entered into with 2nd Respondent shall not affect his rights and remedies against Zenith Finance or any other person(s) whom he believes to be responsible for the alleged fraud, and the Petitioner reserves his right to initiate and/or continue appropriate civil, criminal or other proceedings for recovery of the amount paid under the present settlement and for redressal of his grievances. 9.
The 2nd Respondent submits that in view of the settlement arrived at between the parties and the payment made by the Petitioner, she has no objection whatsoever if this Hon'ble Court is pleased to quash the complaint dated 18.12.2025 and FIR in Crime No.0071/2025 insofar as the Petitioner is concerned. - 5 -

WHEREFORE, the Petitioner and the 2nd Respondent humbly pray that this Hon'ble Court may be pleased to allow this application and permit the parties to compound the alleged offences in Crime No.0071/2025, and consequently, quash the complaint dated 18.12.2025 filed by the 2nd Respondent before the 1st Respondent Police and the First Information Report registered by the 1st Respondent Police in Crime No.0071/2025 for the offences punishable under Section 66(c), 66(d) of the Information Technology Act, 2000 and Sections 318(4), 319(2) of the Bharatiya Nyaya Sanhita, 2023, pending before the in the Hon'ble Principal Civil Judge (Jr. Dn) & JMFC JMFC at Kolar, in the interest of justice and equity.”
5. The affidavit of 2nd respondent reads as follows:
“I, N GLORY, W/o Livistion Kirubagaran, aged about 75 years, residing at #34, Chamrajpet, Andersonpet, K.G.F., Karnataka - 563 113, the 2nd Respondent herein do hereby state on oath as follows:
1. The Petitioner being aggrieved by the filing of Complaint dated 18.12.2025 by the 2nd Respondent before the 1st Respondent Police, based on which the 1st Respondent Police has registered an FIR in Crime No. 0071/2025 for the offences punishable under Section 66(c), 66(d) of the Information Technology Act, 2000 and Sections 318(4), 319(2) of the Bharatiya Nyaya Sanhita, 2023, pending before the in the Hon'ble Principal Civil Judge (Jr. Dn) & JMFC at Kolar, has preferred this instant petition seeking to quash the entire proceeding initiated against him. 2.

WHEREFORE, the 2nd Respondent humbly prays that this Hon'ble Court may be pleased to allow this application and permit the parties to compound the alleged offences in Crime No. 0071/2025, and consequently, quash the complaint dated 18.12.2025 filed by the 2nd Respondent before the 1st Respondent Police and the First Information Report registered by the 1st Respondent Police in Crime No. 0071/2025 for the offences punishable under Section 66(c), 66(d) of the Information Technology Act, 2000 and Sections 318(4), 319(2) of the Bharatiya Nyaya Sanhita, 2023, pending before the in the Hon'ble Principal Civil Judge (Jr. Dn) & JMFC at Kolar, in the interest of justice and equity.”
6. The petitioner has appeared through Video Conference and the respondent No.2 is present before the Court physically and are identified by their respective counsels. 7. In the light of application for compounding being filed along with the affidavits of the parties as quoted supra to the lis and offences not being against the State, I deem it appropriate to accept the affidavits of parties to the lis and terminate the proceedings against the petitioner in the subject petition. 8. For the aforesaid reasons, the following:
ORDER [I] Criminal Petition is disposed.

[II] FIR in Crime No.71/2025 registered by the 1st Respondent (K.G.F. CEN Crime Police Station) for the offences punishable under Sections 66(c), 66(d) of the Information Technology Act, 2000 and Sections 318(4), 319(2), 308(2) of the Bharatiya Nyaya Sanhita, 2023, pending before the Principal Civil Judge (Jr. Dn) & JMFC at Kolar, stands quashed, qua the petitioner.
[III] Complaint dated 18.12.2025 filed by the 2nd Respondent before the 1st Respondent (K.G.F. CEN Crime Police Station) for the offences punishable under Sections 66(c), 66(d) of the Information Technology Act, 2000 and Sections 318(4), 319(2), 308(2) of the Bharatiya Nyaya Sanhita, 2023, stands quashed qua the petitioner.
