Mr. Gouranga Kumar Das and Mr. Ramashis Mukherjee, learned advocates, appear on behalf of the State. Their appearance may be regularized by the concerned authorities.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 3 years 7 months and only three witnesses till date have been examined out of the 18 witnesses cited by the prosecution.
Mr. Gouranga Kumar Das, learned Additional Public Prosecutor appearing on behalf of the State opposes the prayer for bail and submits that son-in-law, namely, Imam Ali Khan, CSW 12
2 is an eyewitness to the incident. Till date the evidence of the said witness is not complete.
Having considered the period of the detention of the present petitioner and the fact that CSW 12 which the prosecution claims to be a vital witness is yet to commence, I am of the view that the learned trial court would prepone the evidence of CSW 12 and after the evidence of the said witness is over, release the petitioner on bail. Such witness be completed within a period of four months from the date of communication of this order.
In view of the aforesaid directions, at this stage, the prayer for bail of the petitioner is rejected. Learned trial court would abide by the directions passed above.
With the aforesaid observations, CRM(M)2789 of 2025 is
disposed of.
