Mr. Somnath Bera …for the State. 1. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. The marriage between the couple took place 22 years ago. The petitioner entered into a second marriage, whereafter the present FIR was lodged. 2. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the statements of witnesses and the injury report of the victim, which shows a lacerated injury at a vital part of the body that required stitches for repair. He also relies on the statement of an independent neighbour, who supported the prosecution case. 3. Considering the above and the other incriminating materials available in the case diary, I do not consider 2 this to be a fit case to grant anticipatory bail to the petitioner. 4. Accordingly, the application for anticipatory bail is rejected. 5. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
