THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.34673 of 2025
ORDER:
1. The present Writ Petition is filed to declare the action of Respondents in not regularizing the services of the Petitioner, not releasing the periodical increments and not considering the case of the Petitioner for further promotion to the post of District Employment Officer, as illegal and arbitrary.
2. The facts in brief are as follows;
The Andhra Pradesh Public Service Commission (for short ‘the APPSC’) had issued a Notification No.10/99 for recruitment to Group-II Services. Pursuant to the said Notification, the Petitioner had applied, attended the examination and secured 315.446 marks. The Petitioner belongs to BC (A) category and is entitled for
consideration in Zone-II as a local candidate. 3. As per the Notification, 104 executive posts and 141 non-executive posts were initially notified and subsequently the Government had withdrawn 141 posts of Assistant Section Officers prior to conduct of written examination, interviews were held for 104 executive posts and candidates were selected for the said 104 executive posts. 4
4. Questioning the action of Respondents in withdrawing 141 posts of Assistant Section Officers, cases were filed vide O.A.Nos.7443 of 2000 and batch before the Andhra Pradesh Administrative Tribunal (for short ‘APAT). After chequered litigation, the Petitioner was eventually selected as Junior Employment Officer in District Employment Exchange, Zone-II, Eluru on 05.12.2017 and is presently working as Junior Employment Officer in District Employment Exchange, Kakinada and has rendered eight (8) years of service, she had qualified in all the Departmental Tests but her probation was yet to be formally declared. The delay in declaration of probation is causing hindrance to the career growth of the Petitioner. 5. The Petitioner had given a representation on 13.10.2025 to the Respondents for declaration of her probation and for consequential regularization of services so as to be enabled for consideration of her case for further promotion as District Employment Officer. As the same is not being considered, the present Writ Petition is filed. 6. The learned Senior Counsel Sri Ravi Kondaveeti appearing for the Petitioner would submit that the probation of the Petitioner is deemed to be declared as per Rule 18 of the Andhra Pradesh State and Subordinate Rules, 1996 as the Petitioner has successfully completed eight (8) years of regular service without any remark,
5
but submits that in the absence of a formal order of declaration of probation, Petitioners’ career progress is getting affected. In that context, the learned Senior Counsel seeks for consideration of Petitioner’s representation dated 13.10.2025. 7. The learned Assistant Government Pleader appearing for the Respondents would submit that the representation of the Petitioner will be considered and appropriate orders would be passed. 8. Considering the submissions made, the Writ Petition is disposed of with the following directions;
(i) The Respondents shall consider the representation dated
13.10.2025 of the Petitioner for declaration of probation and
consequential reliefs of regularization of service and sanction of
increments within a period of four (4) weeks from the date of
receipt of a copy of this order;
(i) No order as to costs. 9.
As a sequel, miscellaneous petitions, pending if any, shall stand closed. _______________________ JUSTICE NYAPATHY VIJAY
