GP MUNCIPAL ADMN AND URBAN DEV AP The Court made the following: 3 ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue a Writ, order or a direction, more particularly one in the nature of Writ of Mandamus, declaring the action of respondents 2, 4 to 6 in orally directing us to stop the development work in L.P.No.6/2024 and vacate the land admeasuring Ac.3.99 cents in Velpur Village, Tanuku Mandal, West Godavari District as illegal, highhanded, arbitrary, against law and violative of Article 300A of the Constitution of India and consequently, i. direct the respondents not to interfere with the peaceful possession and enjoyment of the petitioner’s land, ii. not to interfere with the development work performed by the petitioners in L.P.No.6/2024 situated in the aforementioned law without following due process of law and pass….” 2. Heard the learned counsel for the petitioners, the learned Assistant Government Pleader for Revenue for the respondent Nos.1, 2, 4 to 6 and Mr. Y. Koteswara Rao, the learned Standing Counsel appearing for the 7th respondent. 3. The learned counsel for the petitioners submits that the petitioners are the lawful owners and possessors of the land in an extent of Ac.3.99 cents in Velpur Village, Tanuku Mandal, West Godavari District, and are undertaking development work under approved L.P.No.6/2024. It is further submitted that the respondent Nos.2 and 4 to 6 illegally interfered with the petitioners’ possession and orally directed to stop the development work without following due process of law. Aggrieved by the same, the present writ petition is filed. 4. Mr. Y. Koteswara Rao, the learned Standing Counsel appearing for the 7th respondent, submits that the 7th respondent is not interfering with the petitioners’ possession or development activities of the petitioners’ subject property. 4 5. In view of the above said submission of the learned Standing Counsel for the 7th respondent, no further orders are necessary in this writ petition. However, any dispossession from the subject land shall not be made except by following the due process of law. 6. In the result, the Writ Petition is disposed of. No order as to costs.
