Kausik (Allowed) CRM (NDPS) 1465 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Raiganj Police Station Case No. 1394 of 2025 dated 26.11.2025 under Sections 21(c)/29 of the NDPS Act, 1985. And In the matter of : Samima Bibi @ Samina Khatun ……Petitioner. Mr. Mazhar Hossain Chowdhury ……for the Petitioner. Mr. Arka Naha Ms. Isha Das ……for the State. Learned advocate for the petitioner submits that petitioner has been implicated on the basis of alleged recovery of 410.14 Gms. of Heroin and is in custody for 7 months. Charge sheet has already been submitted and charges have already been framed. Learned advocate for the State opposes the prayer for bail and submits that charges have been framed and witness action is about to commence. Records of the case have been placed before this Court and the Chemical Examiner’s Report reflect presence of Diacetylmorphine and 6-Monoacetylmorphine. Having considered the same has not been quantified and relying upon the judgment of Sentu Seikh vs. State of West Bengal (SLP 2 (Crl.) No. 13987/2025) I am inclined to release the petitioner on bail. Accordingly, Petitioner, namely, Samima Bibi @ Samina Khatun shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge (under NDPS Act), Raiganj, Uttar Dinajpur. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Uttar Dinajpur without the prior permission of the learned Special Court. Thus, CRM (NDPS) 1465 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
