Learned advocate appearing for the petitioners submits that the petitioners have been implicated on the basis of alleged recovery of 16.315 kgs. of ganja. Petitioners are in custody for 107 days and charge-sheet has already been submitted before the jurisdictional court. Learned advocate appearing for the State opposes the prayer for bail. Having considered the quantum of seizure, period of detention and the time which will be taken for the trial to be taken to its logical conclusion, I am inclined to release the petitioners on bail. Accordingly, the prayer for bail of the petitioners is allowed. The petitioner no.1, namely, Sefali Das and the petitioner 2 no.2, namely, Saraswati Roy shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act, Suri Birbhum. If on bail, the petitioners shall be physically present on each and every date before the learned trial court and shall not leave the district of Birbhum without the prior permission of the learned special court. Thus, CRM(NDPS) 1415 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
