D/L15 08.07.2026 Bpg. Dismissed C.R.M. (M) 2790 of 2025 In Re: An application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Magrahat Police Station Case No.251 of 2024 dated 06.07.2024 under Sections 126(2)/117(2)/103/3(5) of the Bharatiya Nyaya Sanhita, 2023; Sona Sarkar @ Raihan Sarkar Versus The State of West Bengal Mr. Soumya Nag Mr. Safiqul Islam. …for the petitioner. Mr. Rajendra Banerjee Ms. Surovi Banerjee. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 4 months and out of 22 witnesses 14 witnesses have been examined and majority of the accused persons named in the FIR has been granted bail. Learned advocate for the State submits that some more time is required for the prosecution to complete the evidence. An emphasis has been made on behalf of the petitioner by producing the evidence of the witnesses. Some of the witnesses were presumably to be taken into consideration while the bail of the prayer was considered in CRM(M)1152 of 2025. As such, I am not inclined at this stage to assess regarding the evidence which has been adduced. Petitioner 2 at the time of renewal of the bail on the next occasion would address the Court on the issue relating to the evidence which has been deposed. At this stage, the prayer for bail of the petitioner in CRM(M)2790 of 2025 is dismissed. A time frame was earlier given to the prosecution. The said time frame has crossed but in the meantime there were certain exigencies for which the learned trial court could not operate. As such, another four months’ time is granted to prosecution to complete whole of the witnesses whom they intend to rely upon in support of its case. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
