JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – husband and his family members are before this Court calling in question proceedings in C.C.No.28207/2024, pending before the XXXII Additional Chief Judicial Magistrate, Bengaluru, for the offences punishable under Sections 498A, 504, 506 r/w. 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioners and respondent No.2 in the respective petitions would submit that the parties to the lis have settled their matrimonial dispute amicably before the concerned Court by drawing up certain terms and conditions before the mediation center. The couple have parted their ways. Therefore, they are before this Court seeking permission to compound the offences. The parties have appended a certified copy of the memorandum of agreement under Section 89 of the CPC r/w. - 5 - HC-KAR NC: 2026:KHC:33826 CRL.P No. 14460 of 2024 C/W CRL.P No. 8935 of 2026 Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2007, in Crl.P.No.8935/2026 to that effect. 3. Learned counsel for petitioners submits that the husband hands over a demand draft of Rs.7.50/- lakhs to the wife and the same is acknowledged by the complainant – wife. 4. The memorandum of agreement reads as follows: “I. The Petitioner has filed the above petition u/s. 13 (1) (ia) of The Hindu Marriage Act - 1955 for Divorce. That the aforesaid petition was referred to Mediation for resolving the dispute between the parties. In the course of Mediation, the parties along with their advocates have participated and have stated as follows:- 1. The Petitioner and the Respondent got married in accordance with Hindu rites, customs and ceremonies on 22-05-2022 AT SHREE CONVENTION CENTER, Banashankari, Bangalore. 2. After the marriage the petitioner and the respondent resided in the house of parents of the petitioner. 3. The petitioner and respondent got separated and started Ilving separately since July 2023. 4. The respondent has filed Crime No. 017/2024 for alleged u/s. 498(A), 504, 506 r/w 34 of IPC r/w Sec. 3 & 4 of Dowry Prohibition Act, 1961 with the Women Police Station, North Division, Sanjaynagar against the petitioner and his family members and it is now pending on the file of Hon'ble XXXII ACJM, Bangalore in CC 28207/2024. - 6 - HC-KAR NC: 2026:KHC:33826 CRL.P No. 14460 of 2024 C/W CRL.P No. 8935 of 2026 5. The petitioner's sister approached the Hon'ble Court in Crl.P. 14460/2024 seeking quashing of the said proceedings on the file of Hon'ble XXXII ACJM, Bangalore in CC 28207/2024 and the Hon'ble High Court of Karnataka has stayed all further proceedings in the said case. 6. The respondent has instituted proceedings under the provision of Domestic Violence Act 2005 against the petitioner and his family members in C. Misc. No. 193/2024 and the same is pending before the JMFC (Traffic Court) II at Bangalore. 7. That the Petitioner and the respondent have agreed that the marriage solemnised between them in accordance with Hindu rites, customs and ceremonies on 22.05.2022 AT SHREE CONVENTION CENTER, Banashankari, Bangalore, be dissolved by a decree of divorce. 8. The petitioner has agreed to pay a sum of Rs.22,50,000 (Rupees Twenty Two Lakhs Fifty Thousand only) to the respondent in full and final settlement of all claims; the respondent has agreed to the same. 9. The petitioner undertakes to withdraw C. Misc No. 193/2024 which is filed under the provision of Domestic Violence Act 2005 against the petitioner and his family members. 10. The respondent undertakes to cooperate with the petitioner and his family members in seeking closure/quashment of CC 28207/2024 pending on the file of Hon'ble XXXII ACJM, Bangalore. 11. The petitioner undertakes to hand over a DD for Rs.7,50,000/-(Rupees Seven Lakhs Fifty Thousand only) to the respondent before the - 7 - HC-KAR NC: 2026:KHC:33826 CRL.P No. 14460 of 2024 C/W CRL.P No. 8935 of 2026 Hon'ble Court at the time of reporting the final settlement in the present case. 12. The petitioner undertakes to hand over a DD for Rs.7,50,000/-(Rupees Seven Lakhs Fifty Thousand only) to the respondent before the Hon'ble Court at the time of closure of CC 28207/2024 pending on the file of Hon'ble XXXII ACJM, Bangalore. 13. The petitioner undertakes to hand over a DD for Rs.7,50,000/-(Rupees Seven Lakhs Fifty Thousand only) to the respondent before the Hon'ble Court at the time of reporting the settlement in C Misc. No. 193/2024 on the file of JMFC (Traffic Court) II, Bangalore. 14. The Petitioner and the Respondent have no articles of each other to be exchanged. 15. The Petitioner and the respondent agree that apart from the above agreed terms, they have no claims of any nature whatsoever against each other in respect of maintenance/permanent alimony against each or in respect of the moveable or immoveable properties of each other existing or to be acquired in the future. 16. The petitioner and the respondent undertake not to interfere in the lives of each other in future. II. In view of the aforesaid agreement entered into between the Petitioner and the Respondent, the parties pray that the marriage solemnised between them in accordance with Hindu rites, customs and ceremonies on 22-05-2022 AT SHREE CONVENTION CENTER, Banashankari, Bangalore, be dissolved by a decree of divorce, in terms of the aforesaid agreement. - 8 - HC-KAR NC: 2026:KHC:33826 CRL.P No. 14460 of 2024 C/W CRL.P No. 8935 of 2026 111. Parties to appear before the Court on 29/04/2026 for passing orders in terms of the Agreement.” In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the terms of the memorandum of agreement and terminate the proceedings against the petitioners in both the petitions, as the allegations are not against the State. 5. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petitions are disposed. (ii) The proceedings in C.C.No.28207/2024, pending before the XXXII Additional Chief Judicial Magistrate, Bengaluru, impugned in both the petitions, stand quashed.
