GP FOR HOME The Court made the following: 3 THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI WRIT PETITION NO: 14847/2026 The writ petition is filed under Article 226 of the Constitution of India, seeking the following main prayer: “…..declaring the action of the 3rd Respondent in harassing the petitioner to settle the C.C.No.2728/2025 on the file of Hon’ble IV Additional Chief Judicial Magistrate, Vijayawada with the 4th Respondent to pay the amount of Rs.10,00,000/- (Rupees Ten lakhs only), as illegal, arbitrary, unjust, violation of fundamental rights guaranteed under Articles 14, 21 of the Constitution of India and consequently, direct the 3rd Respondent not to harass the petitioner to settle the dispute in C.C,No.2728/2025 on the file of Hon’ble IV Additional Chief Judicial Magistrate, Vijayawada with the 4th Respondent by paying the amount of Rs.10,00,000/- (Rupees Ten lakhs only) as demanded by him and pass such other order …..” 2. Heard Sri A. Syam Sundar Reddy, learned counsel for the petitioner and learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home submitted written instructions stating that, based on the complaint lodged by the petitioner, a case in Crime No.96 of 2025 was registered on 08.03.2025 by Nunna Police Station for the offences punishable under Sections 329(3), 79 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023. After completion of investigation, charge sheet was filed and the same is now pending as C.C.No.2728 of 2025 on the file of the learned IV Additional Chief Judicial Magistrate, Vijayawada. It is further submitted that respondent No.4 lodged a complaint through the Public 4 Grievance Redressal System (PGRS) on 24.02.2026, which was endorsed to the Station House Officer, Nunna Police Station. Pursuant thereto, the police called both the petitioner and respondent No.4 for a preliminary enquiry. It is specifically stated that the police never harassed the petitioner for settlement of the case in C.C.No.2728 of 2025 pending on the file of the learned IV Additional Chief Judicial Magistrate, Vijayawada with respondent No.4. 4. Recording the same, the Writ Petition is disposed of directing respondent No.3-police not to interfere in the civil disputes as well as in the case pending adjudication before the competent Court between the parties except by following due process of law. There shall be no order as to costs.
