Mr. Ravinder Singh, DAG, Punjab. *** VIKRAM AGGARWAL, J (ORAL) Prayer in the present petition preferred by the petitioner under Section 582 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short the “BNSS”) is for quashing of FIR No.111, dated 05.07.2012, registered under Sections 457 and 380 IPC (Sections 331(4) & 305 of BNS) at Police Station Jhabal District Tarn Taran and all consequential proceedings arising 2. On 29.05.2026, a coordinate Bench passed the following order:- “Learned counsel for the petitioner has submitted that out of total 04 accused, 01 accused has already died and till date the petitioner along with co-accused is facing rigors of pendency of the investigation. Learned State counsel submits that the record of the case was with ASI Jatinder Singh, however, he has lost the record and was dismissed from the service. He submits that the case is under investigation and prays to file an exhaustive status report. Respondent-State is directed to file the status report by way of personal affidavit of Senior Superintendent of Police, Tarn Taran, by examining the case in detail. In compliance with the same, status report by way of affidavit of Sh. Surendra Lamba, Senior Superintendent of Police, Tarn Taran, has been filed in Court today, which is taken on record. Paragraphs 12 to 14 of the said status report read as under:- “12. That after completion of investigation in FIR No.111, dated 05.07.2012, U/s 457, 380 IPC, Police Station Jhabhal, District Tarn Taran, final report U/s 193 BNSS has been presented before Ld. Illaqa Magistrate against accused Davinder Singh @ Dua son of Sukhwant Singh, Satnam Singh @ Satta son of Sher Singh & Harkawanljit Singh @ Kawanl son of Surjit Singh on 25.06.2026 and next date of hearing in the present case before Ld. Illaqa Magistrate is 15.07.2026. 13. That DSP, Sub Division Tarn Taran vide its report of fixing responsibility of erring officials which led to delay in filing the final report had submitted a recommendation, by observing that delay in filing the final report is due to the negligence & dereliction of duty on the part of ASI Satpal No.1785/Tarn Taran and recommended for departmental action against said erring official ASI Satpal No.1785/Tarn Taran and on the basis of recommendation submitted by DSP, Sub Division Tarn Taran, deponent initiated departmental action against erring officials i.e. ASI Satpal No.1785/Tarn Taran vide Memo No.41447-54, dated 30.06.2026 and Sh. Atul Soni, PPS, DSP, Sub Division Bhikhiwind has been appointed as Enquiry Officer to conduct departmental enquiry on day to day basis and to conclude the same within the period of 90 days and to submit the report for taking further departmental action against the said erring official. 14. That deponent has highest regard for the orders passed by this Hon'ble Court and could not even think of defying the orders passed by this Hon'ble Court and in case, Hon'ble Court reaches conclusion of any lapse on part of deponent in compliance of directions issued by this Hon'ble Court, deponent VIKAS CHANDER 2026.07.08 18.03 I attest to the accuracy and integrity of this document CRM-M-24005-2026 (O&M) -3- tenders unconditional & unqualified apology and undertakes to comply all directions/orders passed by the Hon'ble Court.” 4. In view of the same, no further orders are required to be passed by this Court. However, keeping in view the inordinate delay in completion of investigation, the petitioner would be at liberty to seek other remedies as shall be admissible in law as regards grant of compensation etc. 5.
