JUSTICE S VISHWAJITH SHETTY ORAL ORDER This petition under Section 483(1)(b) of BNSS 2023 is filed with a prayer to relax the condition No.3 imposed in Crl.Misc.No.5015/2026 by the Court of IV Additional District and Sessions Judge, Shivamogga, sitting at Bhadravathi, vide order dated 30.01.2026. 2. Heard the learned counsel for the petitioner and the learned High Court Government Pleader on behalf of the respondent - State. 3. Petitioner herein who was arraigned as accused No.1 in Crime No.154/2025 registered by Paper Town - 3 - HC-KAR NC: 2026:KHC:34552 CRL.P No. 5768 of 2026 Police Station, Shivamogga, for offences punishable under Sections 85, 352, 115(2) r/w 3(5) of BNS 2023, along with other accused had filed Crl.Misc.No.5015/2026 before the court of IV Addl. District and Sessions Judge, Shivamogga sitting at Bhadravathi under Section 482 of BNSS 2023, seeking anticipatory bail. The said petition was allowed by the learned IV Addl. District and Sessions Judge, Shivamogga sitting at Bhadravathi vide order dated 30.01.2026, subject to certain conditions. Condition No.3 imposed by the learned Sessions Judge in Crl.Misc.No.5015/2026 vide order dated 30.06.2026, reads as follows: "3. They shall mark their attendance before the Responent Police Station on every Sunday in between 10-00 a.m. to 5-00 p.m., till filing of the final report." 4. Learned counsel for the petitioner submits that petitioner is a resident of Bengaluru. The impugned - 4 - HC-KAR NC: 2026:KHC:34552 CRL.P No. 5768 of 2026 condition has been causing untold hardship to him. Accordingly, he prays to allow the petition. 5. Learned High Court Government Pleader, fairly does not oppose the prayer made in the petition. 6. The petitioner is a resident of Bengaluru and FIR has been registered against the accused for offences punishable under Sections 85, 352, 115(2) r/w 3(5) of BNS 2023. Under the circumstances, I am of the opinion that if the impugned condition imposed in Crl.Misc.No.5015/2026 by the learned Sessions Judge vide order dated 30.01.2026 is relaxed, the same would serve the ends of justice. Accordingly, the following; ORDER (i) Criminal Petition is allowed. (ii) Condition No.3 imposed by the learned IV Addl. District and Sessions Judge, Shivamogga, sitting at Bhadravathi in Crl.Misc. No.5015/2026, disposed of on 30.01.2026 shall - 5 - HC-KAR NC: 2026:KHC:34552 CRL.P No. 5768 of 2026 stand relaxed and all other conditions found in the said order remain unaltered.
