Mr. Arnab Saha …for the petitioners. Mr. Tapan Bhattacharyya Ms. S. Adhikary …for the State. 1. Learned counsel appearing for the petitioners submits as follows. The petitioners stand on the same footing as two other co-accused who were granted anticipatory bail by this Court on 13/12/2021 in CRM 375 of 2021. There was a village rivalry that led to a scuffle. In fact, there are case and counter case. 2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He refers to the injury report and the statements of witnesses. 3. It appears that while granting anticipatory bail, the Division Bench was of the view that the injury as revealed from the injury report was not life threatening. The present petitioners otherwise stand on the same footing as the ones who were granted anticipatory bail. 2 4. Considering the above and the fact that charge sheet has been submitted, I am inclined to grant anticipatory bail to the petitioners. 5. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall not threaten or intimidate witnesses. The petitioners shall surrender before the learned jurisdictional Court and pray for bail within four weeks from date and regularly attend the jurisdictional Court. 6. Accordingly, the application for anticipatory bail is allowed. 7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
