Heard the parties.
Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Tatisilway P.S. Case No.41 of 2026 registered under Sections 103(1), 238 of the B.N.S., 2023.
Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner has committed murder of Abhijit Kumar Tiwary. It is next submitted that the allegation against the petitioner is false. It is then submitted that the petitioner is not named in the FIR and his name has been cropped up on the basis of the confessional statement of the co-accused Akas Sujay Beck. It is further submitted that the petitioner is ready and willing to co-operate with the investigation of the case. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail.
Learned counsel appearing for the State on the other hand opposes the prayer for anticipatory bail of the petitioner and submits that keeping in view the serious nature of allegation against the petitioner of committing murder of Abhijit Kumar Tiwary, his
custodial interrogation is required during the investigation of the case to find out the details of the case. Hence, it is submitted that the petitioner ought not to be given the privileges of anticipatory bail.
Considering the serious nature of allegation against the petitioner and the requirement of his custodial interrogation during the investigation of the case to find out the details of the case, this Court is not inclined to give the privileges of anticipatory bail to the above-named petitioner.
Accordingly, the prayer for anticipatory bail of the above- named petitioner is rejected.
