Y KOTESWARA RAO The Court made the following: 3 THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.34983 of 2025 ORDER: The present writ petition is filed seeking the following relief: “….to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents 2 to 5 in proposing to construct Community function hall on the public road in an extent of Ac.0.85 cents covered by Survey No.472-7 situated in Dubhacharla Village of Nallajerla Mandal revenue limits in East Godavari District, without protecting the same for public purpose as illegal, irregular, arbitrary, without jurisdiction, violative of provisions of Andhra Pradesh Board Standing Orders and Offends Articles 14, 21 and 300A Constitution of India and consequently direct the respondents 2 to 5 to protect the public road „Bandi Dhaari‟ in an extent of Ac.0.85 cents covered by Survey No.472-7 situated in Dubhacharla Village of Nallajerla Mandal revenue limits in East Godavari District….” 2. Heard learned counsel for the petitioners, learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 4 and learned Standing Counsel appearing for respondent No.5. 4 3. Learned Assistant Government Pleader, on instructions, has submitted that based on the resolution passed by the Gram Panchayat it was proposed to construct a community function hall in the land in Survey No.472-7 situated in Dubhacharla Village of Nallajerla Mandal, East Godavari District. 4. Learned Standing Counsel appearing on behalf of the 5th respondent has submitted that though the resolution has passed in 2018, now there is no such proposal. 5. If at all any such proposals are made for construction of community hall, the respondents are directed not to convert the land in Survey No.472-7 situated in Dubhacharla Village of Nallajerla Mandal, East Godavari District as the same is recorded as „Bandi Dari‟. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
