ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to Issue a Writ of Mandamus or any other appropriate Writ,
Order or Direction, declaring the impugned order bearing Rc.No.02/LS/2026 dated 18.05.2026 passed by respondent No. 3 under Section 83(2) of the Endowments Act 30 of 1987 (as amended by Act 36 of 2023) as being illegal, arbitrary, without jurisdiction, contemptuous, violative of principles of natural justice, and contrary to the orders of this Hon'ble Court and to set-aside the same consequentially suspend the operation and implementation of the impugned order bearing Rc.No.02/LS/2026 dated 18.05.2026 passed by respondent No.3 by restraining the respondent Nos. 3 from taking any coercive action against the petitioners pursuant to the said impugned order, including but not limited to taking possession of the subject property i.e., in Survey No.162/2, Mantralayam Village, Kurnool District, to an extent of Ac.4-77 cents and to pass…”

The learned Assistant Government Pleader for Endowments submitted that since the impugned order passed by the respondent No.3 under Section 83(2) of Endowments Act 30 of 1987 (in short „Act, 1987), appeal is provided under Section 83(6) of the Act, 1987 to approach the Tribunal constituted under Section 87 of the Act, 1987. 3. Heard Sri K. Sitaram, learned counsel for the respondent No.3 appearing through video conference submitted that there is an alternative effective remedy provided under Section 83(6) of the Act, 1987 and the petitioners may approach the Tribunal. 4. In reply, the learned counsel for the petitioners submits that the impugned proceedings are issued without considering the explanation

as such they may be stayed till the petitioners take necessary steps to approach the Tribunal challenging the order passed by the 3rd respondent. 5. In view of the submissions made regarding the non providing of opportunity of hearing to the petitioner and non-consideration of the explanation in proper perspective, the respondents are directed to maintain status quo with regard to subject property in all respects and the petitioners are directed to approach the Endowments Tribunal under Section 87 of the Act, 1987 within a period of four (04) weeks from the date of receipt of this order. 6. In the meanwhile, the order impugned in this writ petition i.e., Rc.No.02/LS/2026, dated 18.05.2026 is stayed for a period of eight (08) weeks and the petitioners are at liberty to file necessary application for interim orders protecting their interest before the learned Tribunal. 7. Accordingly, the writ petition is disposed of. As a sequel, pending applications, if any, shall stand closed.
