APP Mr. Shataroop Purkayastha … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for about a year; charge-sheet has been submitted and the case is yet to be committed before the learned Sessions Court. Learned advocate also emphasizes that some of the similarly placed accused persons have been granted bail. Learned advocate for the State opposes the prayer for bail. I have taken into account the statement of some of the eyewitnesses under section 164 of the Cr.P.C. Having considered the locus of the present petitioner in respect of the another accused who has been granted bail, I am of the opinion that further custodial detention of the present petitioner is unwarranted. 2 Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Nepal Roy shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned ACJM, Tehatta. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned court and shall not leave the district of Nadia without prior permission of the learned court.
