Brief facts of the case are that on 01.11.2025 at about 3:00 p.m., the Divisional Excise Flying Squad, Ambikapur, conducted a search at the P.G. College Ground, Ambikapur, during which 25 Rexogesic Buprenorphine Injection IP (2 ml each), having a total quantity of 50 ml, were allegedly recovered and seized from the exclusive possession of the present Applicant. On the basis of the said recovery, the Applicant was implicated in the present case. Hence, this application. 3. Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is contended that although the Applicant has been implicated along with the co-accused, the alleged commercial quantity of the contraband was recovered from the joint possession of the Applicant and the co-accused. It is further submitted that the Applicant has been falsely implicated because the police wanted him to act as a witness in several other cases and upon his refusal, he was roped into the present case. He further submits that the Applicant has been in judicial custody since 01.11.2025 and the trial is likely to take considerable time for its conclusion, therefore, he may 3 be enlarged on regular bail. 4. On the other hand, learned State Counsel opposes the bail application and submits that the present Applicant is actively involved in the commission of the alleged offence and that the alleged recovery is of commercial quantity. 5. Considering the submissions advanced by learned Counsel for the parties, the nature and gravity of the allegations, the material available in the case diary, the fact that the alleged recovery is of commercial quantity and without commenting anything on the merits of the case, this Court is not inclined to grant regular bail to the present Applicant. 6. Accordingly, the bail application of the Applicant – Suresh Verma,, involved in Crime No.140/2025 registered at Police Station – Divisional Excise Flying Squad, Division Ambikapur, District- Surguja (C.G.), for the offence under Section 22 (C) of NDPS Act is hereby rejected. 7.
