Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years 4 months and the recovery in the present case is 62.800 kgs. of Ganja. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. I have taken into account the period of detention of the present petitioner and I direct the learned Trial Court to complete the examination of the seizure list witnesses within a period of three months from the date of communication of this order. If the learned Trial Court, after the evidence of the independent witnesses, is of the opinion that there has been some dilution in the prosecution case, then in such circumstances on an application for bail, the same may be considered leniently by the learned Trial Court. 2 At this stage, the prayer for bail of the petitioner is rejected. Learned Trial Court would adhere to the aforesaid directions. The application for bail, being CRM (NDPS) 1402 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
