Case No. 518 of 2023). And In Re : Tarun Naskar ... Petitioner. Mr. Karan Bapuli, Mr. Tirtharaj Ghoshal ... For the Petitioner. Mr. Kallol Mondal, Ld. PP, Mr. Anamitra Banerjee ... For the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 3 years 3 months and till date, only two witnesses have been examined out of 17 witnesses cited in the charge-sheet. Some of the accused persons have been granted bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that delay in the present case was because of the accused persons and systematic delay and prosecution did put in efforts to conclude the trial. I have taken into account the overall circumstances of the case and genesis of the dispute. Without entering into the merits of the case, but only considering the period of detention of the present petitioner, I am of the opinion that 2 the present petitioner viz., Tarun Naskar be released on bail by the learned Trial Court on the same terms and conditions as another accused viz. Badal Naskar who has been granted bail on 20.02.2026 in CRM (M) 2089 of 2025. Accordingly, the prayer for bail of the petitioner is allowed. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1160 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
