Heard the parties.
This criminal miscellaneous petition has been filed by the petitioner with the prayer for restoration of B.A. No.7672 of 2026 to its original file which stood dismissed for non-compliance of the peremptory order dated 14.08.2026 passed by this Court.
It is submitted by the learned counsel for the petitioner that B.A. No.7672 of 2026 stood dismissed for non-compliance of the peremptory order dated 14.08.2026 passed by this Court to file a supplementary affidavit annexing therewith the certified copy of the latest order sheets of the trial court of each of the cases, apart from that case, in which is the petitioner is involved showing that he has intimated the courts concerned of the said cases; that he has been in custody in connection with that case. It is next submitted that due to bonafide mistake, the advocate’s clerk could not annex the index to the supplementary affidavit at the time of filing of the same and due to the said defect, the filing section did not accept the said supplementary affidavit, hence, the said affidavit could not be filed
within the stipulated time which resulted in dismissal of the said B.A. No.7672 of 2026 for non-compliance of the said peremptory
order dated 14.08.2026 passed by this Court. It is next submitted that non-compliance of the said peremptory order dated 14.08.2026 was neither deliberate nor intentional. It is also submitted that the petitioner has very good grounds to agitate in the said B.A. No.7672 of 2026 and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that the B.A. No.7672 of 2026 be restored to its original file.
Learned counsel appearing for the State has not raised any serious objection.
Considering the aforesaid submission of the learned counsel for the petitioner, B.A. No.7672 of 2026 is directed to be restored to its original file at the same stage at which it was before its dismissal.
Registry is directed to list B.A. No.7672 of 2026 before the concerned Bench after a week.
This criminal miscellaneous petition is disposed of accordingly.
