01. The Oriental Insurance Company (for short “the Appellant- Insurance Company”) had moved Mac App No. 8/2024 under Section 173 of the Motor Vehicles Act, seeking setting aside of Award dated 6th of November, 2023 passed by the learned Motor Accident Claims Tribunal, Kupwara in Claim Petition titled “Mst. Zeba Begum & Ors. V. Amit Singh & Ors.”
02. In terms of Order dated 9th of December, 2025, this Court, while issuing notice to the other side, had directed that subject to Appellant depositing the Award amount, along with interest calculated upto date within six weeks before the Registry of the Court, the execution proceedings shall remain stayed. 03. The Appellant-Insurance Company has now moved CM No. 5679/2026 seeking withdrawal of the aforesaid appeal, pleading that the parties have settled to payment of the awarded amount and the same has also been deposited with the Executing Court. 04. For the reasons stated in the application bearing CM No. 5679/2026 and those urged at the Bar, the application is allowed and Mac App No. 8/2024 shall stand dismissed as withdrawn.
The statutory amount, if any, deposited by the Appellant-Insurance Company before the Registry of this Court is ordered to be returned to the Appellants through available mode, through their Counsel, against proper receipt. 05. CM No. 5679/2026 shall stand disposed of, accordingly. (M. A. CHOWDHARY)
