GP FOR HOME The Court made the following: 3 THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI WRIT PETITION NO: 14872/2026 The writ petition is filed under Article 226 of the Constitution of India, seeking the following main prayer: “…..declaring the action of the Respondent No.4 in calling the petitioner to Police Station at the instance of unofficial Respondent Nos.5 to 7 in a purely civil matter as illegal, arbitrary and unconstitutional and consequently, to direct the Respondent Nos.4 to 7 not to call the petitioner to the Police Station of Respondent No.4, and to pass…..” 2. Heard Sri Syed Kaleemulla, learned counsel for the petitioner and learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home submitted written instructions stating that a complaint was received from respondent Nos.5 and 6 alleging cheating, criminal breach of trust, misappropriation of chit fund amounts and criminal conspiracy, pursuant to which the petitioner was called for preliminary enquiry. However, the petitioner did not turn up and the matter is still pending enquiry. It is further stated that earlier also the petitioner had filed W.P.No.6541 of 2026 before this Court on similar allegations and the said writ petition was disposed of granting liberty to the petitioner to approach the competent Court for appropriate relief in accordance with law. 4. Considering the written instructions submitted by the learned Assistant Government Pleader for Home, the Writ Petition is disposed of directing the respondent-police to follow the procedure contemplated under law for 4 securing the presence of the petitioner for the purpose of preliminary enquiry. It is further observed that the petitioner is at liberty to approach the appropriate forum seeking appropriate remedies in accordance with law. There shall be no order as to costs.
