The petitioner has filed the instant petition for following reliefs:- “10.1 It is therefore prayed that, This Hon’ble Court may kindly pleased to issue a writ/order/directions to direct the respondent No. 10 to decide the Second Appeal registered as Case No. 202301250800007/A-6/2023-24 parties Bina Soni & Anr Vs Shitla Soni & Ors, within stipulated time period in the interest of justice. 10.2 Any other relief/reliefs, which this Hon’ble Court may think fit and proper in the facts and circumstances of the case, may also please be granted to the petitioners.” 2. Learned counsel for the petitioners submits that the petitioners had preferred a second appeal before the Commissioner, Bilaspur Division, 3 on 11.09.2024, which is still pending consideration. It is further submitted that, in the circumstances, the present petition has been filed seeking a direction to the concerned Commissioner to consider and decide the said appeal expeditiously, in accordance with law. 3. Learned counsel for the State does not oppose the limited prayer as made by counsel for the petitioners. 4. Heard learned counsel for the parties and perused the material available on record. Considering the facts and circumstances of the case, and taking into account that the appeal preferred by the petitioners before the Commissioner, Bilaspur Division has remained pending since 11.09.2024, this Court deems it appropriate to direct the Commissioner, Bilaspur Division, to consider and decide the said appeal expeditiously, preferably within a period of 90 days from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the case. The Commissioner shall decide the appeal independently, strictly in accordance with law, and without being influenced by any observations contained in this order. 5.
