For the Petitioner : Mr. Brij Bihari Sinha, Advocate
For the Opp. Party no. 1 : Special P.P.
For the Opp. Party no. 2 : Mr. Abhishek Kumar, Advocate

2/21.09.2026 Heard Mr. Brij Bihari Sinha, learned counsel for the petitioner and Mr. Abhishek Kumar, learned counsel for the opposite party no. 2.
This application has been preferred against the order dated 18.02.2025 passed by the learned Principal Judge, Family Court, Bokaro in Original Maintenance Case No. 92 of 20204 whereby and whereunder the petitioner has been directed to make payment of Rs. 5,000/- per month as interim maintenance to the opposite party no. 2.
It has been submitted by the learned counsel for the petitioner that in spite of best efforts of the petitioner to keep the opposite party no. 2 with him with full dignity and honour, she has without any reasons refused to stay with him. It has also been submitted that the petitioner was having a job, but on account of the present proceeding as well as a proceeding under Section 498A of I.P.C. instituted against the petitioner, he was dismissed from service and at the present moment, he is jobless and therefore maintenance amount of Rs. 5,000/- being on the higher side, deserves to be quashed and set aside.
Learned counsel for the opposite party no. 2 has submitted that a meagre amount of Rs. 5,000/- was awarded as maintenance to the opposite party no. 2.
It appears that on 29.07.2026, the petitioner as well as the opposite party no. 2 were physically present in court and opposite party no. 2 has
-2- refused to stay with the petitioner stating that she has been traumatized during her stay at her matrimonial house with the petitioner and her in- laws and on account of mental trauma, she has undergone, she has been undergoing treatment at C.I.P., Ranchi. It has been stated by the learned counsel for the petitioner by referring to the impugned order dated 18.02.2025 that the opposite party no. 2 is an Intermediate and the petitioner claims that she earns an amount of Rs. 30,000/- from Beauty Parlour and Rs. 10,000/- from private tuition, though nothing in support of such contention has been produced by the petitioner. The petitioner appears to be an M. Tech and he has the educational qualification which would enable him to make payment of maintenance to the opposite party no. 2. The learned trial court on consideration of the entire facets of the case has rightly awarded interim maintenance of Rs. 5,000/- to the opposite party no. 2 and there being no reason to conclude otherwise, this application stands dismissed.
