[ Mr. Sourajit Dasgupta Ms. Nitu Singh Mr. Anurag Kumar Ms. Ayesha Khatoon Mr. Basupriya Chattopadhyay Ms. Ritika Kedia …for the petitioners This application under Article 227 of the Constitution of India is at the instance of the defendants praying for a direction upon the Learned Civil Judge (Junior Division), at Kalyani, Nadia, to dispose of Title Suit No. 261 of 2025 expeditiously. The learned Advocate appearing for the petitioners submits that three applications – one under Order 39 Rule 1 and 2of the Code of Civil Procedure filed by the opposite parties; the second application under Order 39 Rule 4 of the Code of Civil Procedure filed by the petitioners for vacating the interim order of injunction and the third application under Order 7 Rule 11 of the Code of Civil Procedure for rejecting the plaint – are pending. He prays for a direction upon the learned trial judge to dispose of the said applications expeditiously. The learned Advocate appearing for the petitioners further submits that the applications under Order 39 Rule 1 & 2 and the application under Order 39 Rule 4 of the Code of Civil Procedure are ready for hearing as the written objections thereto have been filed by the respective parties. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite parties. However the learned Advocate-on-Record for the petitioners shall be obliged to forward a copy of this application along with a server copy of this order to the opposite parties forthwith. In the light of the submission made by the learned Advocate for the petitioners, this civil revisional application stands disposed of by requesting the learned Civil Judge (Junior Division), Kalyani to take up the hearing of the aforesaid interlocutory applications on the next date fixed, if the same are otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. It will be open to the learned Trial Judge to decide which of the said applications shall be taken up first for hearing. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requite formalities. (Hiranmay Bhattacharyya, J.) 2
