2 / 3 (Hon’ble Shri Justice Bibhu Datta Guru) Order on Board 16/07/2026
1. The present contempt petition alleges willful and deliberate disobedience of the order dated 23.11.2021 passed by this Court in WPS No.1009/2015, particularly the direction requiring the respondents to ensure that the salary payable to the petitioner is not stopped in any manner. 2. During the course of hearing, learned counsel appearing for the respondents has invited the attention towards the covering memo dated 16.07.2026 and the communication dated 11.09.2025 issued by the Directorate of Public Instructions, Chhattisgarh, demonstrating that the petitioner's dues have been duly calculated and it has been pointed out that an amount of Rs.81,71,590/- has been paid and the outstanding amount is only Rs.28,24,526/-. It has further been submitted that in terms of the order dated 23.11.2021, if there was any delay in release of the admissible amount, the same would carry interest @ 10% per annum till the date of actual payment, as specifically directed by this Court. 3. Having considered the material placed on record, this Court is of the opinion that the direction contained in the order dated 23.11.2021 itself adequately safeguards the interest of the petitioner by providing for payment of interest @ 10% per annum in case the amount was not released within the stipulated period.
It appears from the covering memo filed by the Respondents/contemnors No.1 & 2 that though there is some delay in releasing the subject amount but the order passed by this Court
3 / 3 has been substantially complied with. 4. The grievance, if any, regarding delayed payment is thus sufficiently taken care of by the very order sought to be enforced. In the facts of the present case, no material has been brought on record to establish any wilful or deliberate disobedience of the order of this Court so as to warrant initiation of proceedings under the Contempt of Courts Act. 5. Accordingly, no case for proceeding further in contempt jurisdiction is made out. The contempt petition is, accordingly, disposed of. Rule is discharged. SD/- SD/- (Bibhu Datta Guru)
