HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR (THROUGH VIRTUAL MODE) Case: CM(M) No. 375/2026 Saima and anr. ..... Petitioner(s)/Appellant (s) Through :- Ms. Nadiya Mushtaq, Advocate. v/s Union Territory of J&K. .....Respondent(s) Through :- CORAM: HON’BLE THE CHIEF JUSTICE (ACTING) HON’BLE MR. JUSTICE MOHD. YOUSUF WANI, JUDGE ORDER 27.08.2026 01. In this petition, the petitioners seek writ of mandamus to direct the trial Court to conclude the trial of the case FIR No. 120/2023 titled “UT of J&K vs. Farooq Ahmad Parra and ors.” in a time bound manner. 02. We are afraid that we cannot issue any such mandamus to the trial Court. It is for the trial court to ensure that the cases pending before it are taken up and decided with necessary promptitude, of course, having regard to the pendency of similar cases. Issuing directions to the trial court to conclude the trial in time bound manner would create a chaotic situation for the trial Court to handle the huge pendency. 03. Be that as it may, having regard to the fact that in the case of like nature, the liberty of the citizens is involved, we expect that the trial court shall not grant any unnecessary adjournments to the prosecution and ensure that the witnesses are produced at regular intervals and examined on time. 04. With these observations we dispose of the instant petition. (MOHD. YOUSUF WANI) (SANJEEV KUMAR) JUDGE CHIEF JUSTICE (A) JAMMU 27.08.2026 Sunita Sr. No. 12 SUNITA KOUL 2026.08.29 17:00 I attest to the accuracy and integrity of this document
