Rakib (Rejected) CRM (NDPS) 1389 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Dhubulia Police Station case no. 285 of 2024 dated 03.08.2024 under Sections 20(b)(ii)(c)/25/29 of the NDPS Act. Mr. Shataroop Purkayastha ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been implicated in connection with the instant case for alleged recovery of 55.190 kgs of ganja. Petitioner is in custody for 11 months and charge has already been submitted. There is no possibility of the trial concluding in near future. As such, petitioner may be released on bail. Learned advocate appearing for the State opposes the prayer for bail. I have taken into account the quantum of seizure in the present case and the fact that witness action is about to commence, I am not inclined to release the petitioner on bail. 2 Petitioner would renew his prayer for bail after the evidence of seizure list witnesses are over. Learned trial Court would ensure that the evidence of seizure list witnesses are completed within a period of three months from the next date fixed. With the aforesaid observations, CRM (NDPS) 1389 of 2026 is dismissed at this stage. Learned advocate for the petitioner and/or State would be at liberty to communicate this order to the learned trial Court. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
