1. This first anticipatory bail application under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.07.16 19:31:05 +0530
2 applicants, who are apprehending their arrest in connection with Crime No.529/2026 registered at Police Station – Khamtarai, District - Raipur (C.G.) for the offence punishable under Sections 316 (5), 318 (4) & 60 (a) of Bharatiya Nyaya Sanhita.
2. The prosecution story, in brief, is that on 14.5.2026 the complainant has lodged an FIR stating that the applicants have purchased sugar from the complainant. On 27.4.2026 the complainant has supplied 42 tons of sugar amounting to Rs.17,00,999/- and on 5.5.2026, the complainant supplied 40 tons of sugar amounting to Rs.16,47,996/- from Raipur. It is alleged that some amount has been paid by the applicants and the remaining amount of Rs.22,98,994/- has not been paid by the applicants. Thereafter FIR was registered. Hence, the bail application.
3.
Learned counsel for the applicant submits that the applicants are innocent and have been falsely implicated in the present case. He further submits that the applicants have been purchasing the sugar from the complainant and other persons since 2023 and in the regular course of business goods have been received and timely payment has also been made and allegation in the FIR is for the remaining amount to be paid by the applicants. The allegations made in the FIR are entirely based upon commercial transaction and do not disclose any dishonest or fraudulent intention on the part of the applicants. Therefore the applicants be released on anticipatory bail. 3
4. On the other hand, learned State counsel and learned Senior Counsel for the Objector have no objection in allowing the present anticipatory bail application. However, learned Senior Counsel for the objector would submit that the remaining amount has already been paid by the applicants. 5. I have heard learned counsel for the parties and perused all of the documents taken on record. 6. Considering submissions of learned counsel for the parties and further considering the fact that the applicants have already paid the remaining amount to the complainant and the complainant has no objection in allowing this bail application, as such, this Court is inclined to extend the benefit of anticipatory bail to the applicants. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Rajesh Agrawal & Shailesh Kumar Agrawal, on executing a personal bond with one surety in the like sum to the satisfaction of the Arresting Officer, they shall be released on bail on the following conditions:- (a) they should not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) they should not act in any manner which will be prejudicial to fair and expeditious trial. (c) they should appear before the trial Court on each and every date given to him by the said Court till
4 disposal of the trial. (d) The Applicant and the sureties shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
(e) they should not involve themselves in any offence of similar nature in future. Sd/- (Ramesh Sinha) CHIEF JUSTICE Barve
