JUSTICE P SREE SUDHA ORAL ORDER This Civil Petition is filed seeking transfer of O.S.No.198/2023, pending on the file of the VI Additional Senior Civil Judge and JMFC, Mysuru, to any Civil Court in Bengaluru City. 2. Learned counsel for the petitioner submitted that the petitioner is the defendant in the said suit and the respondent is also residing in Bengaluru. The said suit has been filed for recovery of money. The petitioner is a financial adviser and a licensed mutual fund distributor. It is contended that he - 3 - HC-KAR NC: 2026:KHC:19601 CP No. 515 of 2024 had agreed to act as a bridge for transferring the respondent’s funds to M/s Excellent Solars with the consent and knowledge of the respondent. But the respondent has filed the suit for recovery of Rs.11,85,161/- with interest at the rate of 12% before the Court at Mysuru, though the petitioner is a resident of Bengaluru and M/s Excellent Solars is also located in Bengaluru. The petitioner is a senior citizen and his daughter is suffering from health issues. Therefore, it is inconvenient for him to travel to Mysuru, which is at a distance of about 145 kilometres from Bengaluru. 3. In spite of service of notice, the respondent has not appeared before this Court. Therefore, this Court finds that it is just and reasonable to transfer O.S.No.198/2023 from the Court of VI Additional Senior Civil Judge and JMFC, Mysuru, to any Civil Court in Bengaluru City.
