THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 and 2 are before this Court calling in question registration of a crime in Crime No.132/2026, pending before the XXXIX Additional Chief Judicial Magistrate Court, Bengaluru, for the offences under Sections 74, 75, 115(2), 352 r/w. 3(5) of the BNS. 2. Learned counsel for the petitioners and respondent No.2 in unison would submit that the parties to the lis have entered into compromise amongst themselves by drawing up certain terms and conditions and therefore, they are before this - 3 - HC-KAR NC: 2026:KHC:33639 CRL.P No. 9527 of 2026 Court seeking permission to compound the offences. The parties have filed a memorandum of settlement / compromise petition under Sections 359 r/w. 528 of the BNSS, 2023 along with a joint affidavit before this Court to that effect. 3. The memorandum of settlement reads as follows: “1. XXXX 2. XXXX 3. XXXX 4. It is submits that, the allegation and counter allegation made by parties against each other, as a result of which criminal proceedings initiated against them due to personal dispute both the parties have lodged the complaint. Both the families are residing in KMF quarters as neighborers. On the intervention of well-wishers and family members and residents of locality both petitioners and complainant are willing to settle the criminal dispute pending against them amicably by way of compromise and also not intending to continue criminal prosecution against each other. Both of them are willing to compound the offence alleged against them with the lieu of this Hon'ble court in order to continue hormonial relationship between them. In view of the same the parties are seeking for the compound the offence. 5. It is submit that, the dispute is between the neighbourers who are residing in the said premises since long back and both are working at KMF both have been continued their cordial relationship since from long time. At the spur of moment alleged incident endeavor between the parties. Now they are very much cordial with each other and the complainant and Victim are not willing to continue the proceedings against the petitioners, and both are going to withdraw the allegations and contra allegation made against each other. In view of the above aspects this Hon'ble court permit the petitioners and the complainant to compound the - 4 - HC-KAR NC: 2026:KHC:33639 CRL.P No. 9527 of 2026 offence consequently the FIR laid against the petitioners is liable to be quashed by this Hon'ble court.” In the light of the afore-quoted memorandum of settlement, I deem it appropriate to terminate the proceedings against the petitioners, as the dispute and the allegations are between the individuals and not against the State. 4. 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is disposed. (b) The impugned crime in Crime No.132/2026, pending before the XXXIX Additional Chief Judicial Magistrate Court, Bengaluru, qua the petitioners, stands quashed.
