08-07-2026 ct no. 13 Sl. 11 sp F.M.A. 532 of 2026 The Teacher-in-Charge, Shree Maheshwari Vidyalaya -Versus- Sri Ajay Shankar Upadhyay & Ors. Mr. Achyut Basu, Ms. Punam Basu, Mr. Srikumar Chakraborty, Mr. Amritanshu Sengupta. …for the appellants. Mr. S. Bhattacharya, Ms. Mary Datta. ..for the State. 1. The appeal is directed against judgment and order dated 24th February, 2026 passed by a Single Bench of this Court. 2. By the said order, CAN 1 of 2026 being an application filed by the school seeking recall and modification of the order dated 10th February, 2026 was rejected. The Court found that there was reference to an order dated 9th February, 2026. In the proceedings, no such order was found. In fact, on the 10th of February, 2026, the Single Bench had imposed costs which were not paid. 3. In the backdrop of the above, the school’s application was dismissed and the report on affidavit filed by the respondent nos. 4 and 5 and exception thereto was taken on record. 2 The matter was fixed for hearing on 26th March, 2026. This Court finds no reason to interfere with the discretionary order passed by the Single Bench under Article 226 of the Constitution of India. 4. Hence, FMA 532 of 2026 shall stand dismissed. 5. Consequently, all connected applications, if any, shall stand disposed of. 6. There shall be no order as to costs. 7. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Rajasekhar Mantha, J.) (Ananya Bandyopadhyay, J.)
